1. STORAGE AGREEMENT
1.1 Storage Services
Kapotas provides climate-controlled indoor storage for eligible Jeep Wrangler and Ford Bronco hardtops.
Removal, pickup, transportation, return delivery, and reinstallation are governed by the applicable service order and Terms of Service.
1.2 Storage Rate and Minimum Term
Storage costs $69 per consecutive 30-day storage period.
A minimum commitment of three consecutive storage periods applies.
The initial storage charge is:
$69 × 3 storage periods = $207
The entire $207 initial storage charge must be prepaid when Kapotas removes, picks up, or otherwise accepts possession of the hardtop.
1.3 Initial Payment
Unless otherwise stated in writing, initial charges are:
Service package: $249
First three storage periods: $207
Initial total: $456
Reservation deposit already paid: $50
Remaining balance due at pickup: $406
Applicable taxes and approved additional charges may be added.
The $50 reservation deposit is applied toward the initial total and is not an additional fee when the scheduled service is completed.
1.4 Beginning of Storage
The first 30-day storage period begins on the date Kapotas removes or otherwise accepts possession of the hardtop.
Storage periods are measured in consecutive 30-day intervals rather than calendar months.
1.5 Automatic Renewal
After the initial three storage periods, storage automatically continues in additional 30-day periods unless the customer schedules retrieval and satisfies all release requirements.
Each additional storage period costs $69, plus applicable taxes or authorized charges.
The charge will be processed before the beginning of the next 30-day period.
1.6 Credit Card on File and Recurring Authorization
A valid credit card must remain on file throughout the storage period.
The customer authorizes Kapotas and its third-party payment provider to automatically charge the card on file for:
Additional 30-day storage periods;
Applicable taxes;
Approved additional transportation;
Failed delivery or reinstallation attempts;
Additional services requested by the customer; and
Other charges authorized under the service order or Storage Agreement.
The customer is responsible for updating expired, replaced, declined, or invalid payment information.
1.7 Failed Payments and Outstanding Balances
If a payment is declined or cannot be processed, Kapotas may contact the customer and request updated payment information.
Storage charges continue while the hardtop remains in Kapotas’ possession.
A hardtop cannot be released, delivered, or reinstalled while an authorized balance remains unpaid.
Before release, the customer must pay all outstanding:
Storage charges;
Transportation charges;
Additional service charges;
Preservation expenses;
Legally permitted collection expenses; and
Other authorized amounts.
Kapotas may exercise lien rights or other remedies available under applicable Florida law. Any lien enforcement, sale, or disposition will occur only through legally required notices and procedures.
1.8 Property Identification
Kapotas may identify stored property using:
Customer name;
Vehicle make, model, year, and color;
Vehicle identification number;
License plate;
Internal storage number;
Barcode or numbered tag;
Service-order number;
Photographs; and
Other distinguishing information.
Factory bolts, removable panels, wiring components, and accepted accessories may be labeled and stored with or near the hardtop.
1.9 Condition Documentation
Kapotas may inspect, photograph, or record the hardtop and vehicle:
Before removal;
During removal;
During transportation;
Upon arrival at storage;
Before return delivery; and
After reinstallation.
These records may be used to document condition, identify property, investigate claims, maintain business records, and confirm service completion.
Documentation photographs are part of the service and do not require separate marketing consent.
1.10 Storage Conditions
Hardtops are stored in a climate-controlled indoor facility located at:
5603 NW 159th Street
Miami Gardens, Florida 33014
Kapotas will use commercially reasonable care to:
Identify stored hardtops;
Place hardtops on appropriate storage equipment;
Reduce unnecessary contact between stored items;
Maintain reasonable facility security;
Restrict unauthorized access; and
Protect hardtops from ordinary indoor storage risks.
Climate control does not guarantee that temperature or humidity will remain constant at every moment. Temporary changes may occur because of power failures, equipment failures, severe weather, emergencies, maintenance, or circumstances outside Kapotas’ reasonable control.
1.11 Customer Visits and On-Site Services
Customers may visit the facility during approved hours and by appointment.
Customers may arrange to:
Drop off a hardtop;
Inspect a stored hardtop;
Retrieve a hardtop;
Have a hardtop reinstalled at the facility; or
Receive another approved service.
Customers may not enter restricted storage or employee-only areas without authorization and supervision.
Kapotas may require identification and appointment confirmation before providing access to stored property.
1.12 Customer Insurance
Customers are encouraged to confirm whether their automobile, homeowners’, renters’, specialty-property, or other insurance covers a detached hardtop while it is transported or stored.
Kapotas does not provide personal insurance coverage to the customer or guarantee that every possible cause of loss is insured.
The customer must disclose custom equipment or a hardtop value substantially greater than the ordinary replacement value of a factory hardtop.
1.13 Extraordinary Events
Kapotas will use reasonable care while storing customer property.
Subject to applicable law, Kapotas is not responsible for loss or damage caused solely by circumstances outside its reasonable control, including:
Hurricanes;
Tropical storms;
Flooding;
Building emergencies;
Government action;
Utility failure;
Civil disturbance;
Natural disasters;
Criminal acts by third parties despite reasonable security; or
Other force-majeure events.
Nothing in this section limits responsibility that cannot legally be excluded.
1.14 Retrieval and Reinstallation Notice
The customer must provide at least seven days’ advance notice to request return delivery, retrieval, or reinstallation.
Requested dates are subject to:
Route availability;
Staffing;
Weather;
Vehicle and property access;
Account status; and
Confirmation by Kapotas.
A requested date is not confirmed until Kapotas provides written or electronic confirmation.
1.15 Early Retrieval
The customer may retrieve the hardtop before the end of the initial three-period minimum term.
The following rules apply:
The first storage period is nonrefundable;
The three-period commitment remains the minimum purchased term;
Unused prepaid second- or third-period storage charges are not refunded in cash; and
Eligible unused storage periods are maintained as future Kapotas storage credits.
Storage credits:
Apply only toward future storage charges;
Cannot be applied toward removal, transportation, delivery, or reinstallation;
Have no cash value;
Remain associated with the original customer account; and
Are not transferable unless Kapotas approves the transfer in writing.
The customer should contact Kapotas to confirm the amount and availability of any storage credit.
1.16 Future Service After Early Retrieval
When a customer retrieves a hardtop early and later requests another removal and storage service:
A new $249 service-package charge applies;
Eligible storage credits may be applied only toward future storage charges;
Storage credits cannot be applied toward the new service-package charge;
A new service order and Storage Agreement may be required; and
Current pricing and policies will apply unless otherwise agreed in writing.
1.17 Failed Delivery or Reinstallation
If Kapotas arrives for confirmed return delivery or reinstallation and cannot complete the service because:
The customer is unavailable;
The vehicle is unavailable;
The location is inaccessible;
The vehicle has been modified;
The account has an outstanding balance;
Conditions are unsafe; or
Required authorization has not been provided,
Kapotas may return the hardtop to storage.
Additional transportation, handling, appointment, and storage charges may apply.
Storage charges continue until the hardtop is successfully released.
1.18 Release to Another Person
Kapotas will release a hardtop only to:
The customer named in the Storage Agreement;
A verified co-owner; or
A person specifically authorized by the customer in writing.
Kapotas may require photo identification, written authorization, vehicle information, and account verification before release.
1.19 Change in Ownership
The customer must notify Kapotas if the vehicle or hardtop is sold, transferred, repossessed, or becomes subject to an ownership dispute.
Kapotas may suspend release until satisfactory documentation establishes who is legally entitled to possess the hardtop.
The Storage Agreement may not be transferred to a new owner without written approval from Kapotas.
1.20 Unclaimed Property and Lien Rights
Kapotas may claim a lien against stored property for authorized charges and expenses to the extent permitted by Florida law.
These amounts may include:
Storage;
Transportation;
Labor;
Preservation expenses;
Legally required notices;
Lawful enforcement costs; and
Legally permitted sale expenses.
Kapotas will not treat a hardtop as abandoned solely because a payment is declined or the customer is temporarily unreachable.
Before enforcing a lien or arranging a legally permitted sale or disposition, Kapotas will provide the notices and follow the procedures required by applicable law.
The customer is responsible for keeping all mailing addresses, email addresses, telephone numbers, and emergency contacts current.
1.21 Separate Acceptance
The customer may be required to separately sign or electronically accept this Storage Agreement before Kapotas removes, transports, or accepts possession of the hardtop.
Kapotas may retain the signed agreement, customer information, payment authorization, property-identification records, and documentation photographs electronically.
2. CANCELLATION & REFUND POLICY
2.1 Reservation Deposit
A $50 reservation deposit is required to reserve an appointment.
The deposit is applied toward the amount due when the scheduled service is completed.
2.2 Cancellation With at Least 48 Hours’ Notice
A customer who cancels at least 48 hours before the confirmed appointment time may receive a refund of the $50 reservation deposit.
The customer may instead request that the deposit be transferred to a rescheduled appointment, subject to availability.
2.3 Cancellation With Less Than 48 Hours’ Notice
A cancellation made with less than 48 hours’ notice results in forfeiture of the $50 reservation deposit.
The deposit is not refundable, and a new deposit may be required to schedule another appointment.
2.4 Rescheduling
A customer who requests a schedule change at least 48 hours before the confirmed appointment may transfer the deposit to a new appointment, subject to availability.
A rescheduling request made with less than 48 hours’ notice may be treated as a late cancellation.
Kapotas may make exceptions at its discretion for severe weather, documented emergencies, or unusual circumstances.
2.5 No-Shows and Inaccessible Locations
A customer may be treated as a no-show when:
The customer or authorized representative is unavailable;
The vehicle is unavailable;
The location cannot be accessed;
Required keys, codes, or permissions are unavailable;
The customer provides an incorrect address;
The vehicle is not properly prepared;
The work area is unsafe; or
Kapotas cannot reasonably begin service after arriving.
The reservation deposit will be forfeited.
Additional transportation or service charges may apply before another appointment is confirmed.
2.6 Cancellation by Kapotas
When Kapotas cancels because it cannot provide the service, the customer may choose:
A full refund of the reservation deposit; or
Transfer of the deposit to a new appointment.
Kapotas is not responsible for indirect expenses caused by a cancellation or delay, including lost income, missed travel, rental-vehicle expenses, or other consequential losses.
2.7 Weather-Related Changes
Kapotas may postpone removal, delivery, or reinstallation when weather conditions create an unreasonable safety or property-damage risk.
When Kapotas initiates a weather-related postponement, the customer may transfer the deposit to a new appointment or request a refund.
2.8 Completed Services
Charges for services already completed are nonrefundable, including completed:
Removal;
Pickup;
Transportation;
Delivery;
Reinstallation;
Additional labor; and
Storage already provided.
Kapotas may choose to correct a verified workmanship issue instead of issuing a refund.
2.9 Initial Storage Charges and Early Retrieval
The first three prepaid storage periods are governed by the minimum-storage provisions of the Storage Agreement.
The first storage period is nonrefundable.
Eligible unused second- or third-period charges resulting from early retrieval may be issued only as future storage credits and not as cash or card refunds.
2.10 Refund Processing
Approved refunds will generally be returned to the original payment method.
Processing time depends on the third-party payment provider and the customer’s bank or card issuer.
Kapotas does not control the time required for the customer’s financial institution to post an approved refund.
2.11 Promotional and Discounted Services
Promotional, discounted, bundled, prepaid, or specially priced services may be subject to additional restrictions disclosed at the time of purchase.
